just got a fine in the mail today for doing 71 in a 60 zone. just need to know if i was wrong or not.
i was going down Bussell highway at night time and i spotted the camera half a kilometer away and decided to slow down. the speed limit posted on the board 100 meters before the camera was 80KPH, so i slowed down to 70KPH. the camera was pointing right at me, which i am told is not allowed at night. i went past it and it flashed, and then 100 meters down the road a 60KPH sign was posted. i assumed the camera was just in testing mode or that someone on the other side of the road was flashed, so i drove on. i think i have been fined wrongly because i was doing 70 in a 80 zone not in a 60 zone, as i had not entered the 60 zone until after i got flashed.

From what you have said no you are not at fault.

In vic there is I think 200m after the change in speed zone before that speed can be enforced, so you are still 300m away from where you cannot be exceeding 60km/h.

Ali- no you are not at fault... as long as what you stated above is true..

I had a similar experience recently. I was driving to Busselton and took a scenic route just off the Bussel Hwy. The limit is 100kph which is what i was doing, the a round about and no signage. I kept going 100 when i passed a large tree with a cop car parked behind it.. as i passed they swithced their lights on and pulled me over..

I told them there was no sign, they said, there is one on the side road you came from.. when i told them i didnt come from a side road they told me they saw me make the turn....which is a load od BS.. they still wrote up the ticket but im challenging it as we speak..

moral of the story.. Country cops are wankers.. they will try whatever they can to ya..

good luck contesting it mate..

You may not be at fault, but proving it to the judge is going to be the hard part.

Thats what I was going to say, but without the location of where the camera was placed exactly, I'm not too sure on how much it would help, if it all.

I've actually U-bolted before and asked the guys in the truck what's the deal when i was flashed doing 50~kph in a 60 zone (shortly after pulling out of a driveway).

They just said they're still setting up so i could ignore it.

if you ask for the picture, with video you can easily show where the camera was placed..

my brother in law got off like this. he set up a video in the car showing the area and speed and commenting on what happened. i dont know exactly what happened but he elected to have it heard in court (and presumably submitted the evidence?) but it didnt end up getting heard and was dismissed.

Maybe with a little more info, a fellow member who lives nearby could get some shots for you.

Bussell Hwy is notorious for that and other speed camera related dramas, and Robinson Dr (at the bottom of the hill so it gets every ones speed when going down the hill) that leads onto Bussell Hwy

Me dad got done when we were driving out to Stratham, and where the speed changes from 90km/h to 110km/h he got done ( about 100m from the sign). they must of made a killing of money that night because people start to speed up at when they see the sign. Although the law states you can only do the allocated speed once past the signs.

Just goes to show how much money the government likes to get from speed cameras.

I'm interested to know where you heard this Damian... I was under the impression that in our nanny state, the law stipulates that a speed limit is a speed limit and there are no grey areas. Same kind of thing when you're coasting down a hill.. pick up 5km/h and you're screwed! They've really thrown the onus back on the driver to be responsible for the speed at which their vehicle is travelling.

At fault, no. Will you get a fine? maybe. What will the judge say? Depends on his mood.

It was in the traffic laws and allowing the driver 200m after a speed change sign to adjust there speed was certainly the law my comment of I think only related to is this still current.
