Daniel. I know that guy. He used to do the patrols in Noirthbridge at the back of the Deen etc and is famous for clamping wheels. Hes done quite a few. Last I heard of him he was riding with Team Integrated.. (That pretty much sums him up well)

You really dont want to know who Team Integrated are. Just a bunch of young two-faced wannabees trying to act bigger than they are.
BTW if it is illegal to clamp a vehicle, which is deemed more illegal, the clamping of a vehicle or the vehicle being parked on private property. Its kinda taking the law into your own hands isnt it?
Also, my friend who got clamped returned to her car 20mins after her ticked was expired. She had to pay $140ish to get it off - on the spot. I wonder if this guy can be prosecuted and have all fined revoked for practicing an illegal clamping of vehicle against owners permission law..?
Funny thing is, the person that ordered the clamp, the car bay owner, doesn't get a cent from the fine. The wheel clamper keeps it all, hmmm, that's basically highway robbery. The guy said he does something like 10 to 15 clamps a day if not more, at 150 bux each, that's a lot of money for virtually doing nothing, just drive around the city and wait for a phone call. It's like free money, he terrorises you to pay up now, has no bad debts obviously... I should change my career, he needs some competition there Nah, I reckon a garbo is a lot more respectable job than any other dipsh|t that issues fines...

I'm just gonna buy my own clamp, and from now on park wherever I like, and clamp myself!!
If they're not a council issued ticket, then there cant be any fines related to impersonating/forging, like there would be with a fake parking ticket.
If its just subcontracted to a dodgy operator like this, only thing that can happen is the operator can get shirty at someone else "clamping" on "his turf".
I still think an email outlining your clamping experience sent to ACA / TT / a talkback radio station could be in order here...its exactly this sort of thing they love exposing. Cant wait to see this bloke being chased down by a cameraman, trying to cover his face, and then having some council hack trying to explain why they employ such practices...

Seriously though, you got a point, it's definately jnot a council thing, at least not the Perth City one, since I've spoken to them. You'll be able to park wherever the hell you like. All you'll need too is one of those 'offcial' l;ooking stickers to chuck on your window. Hmmm I could definately use this everyday for work, if I was to drive everyday, parking would cost me like 20 bux!

Now from a legal point of view, let me clarify something for yous all! Duane (or bluff, whatever he calls himself) isn't hired by the council, only by a private party. I believe the reason why he puts clamps on and takes the money straight away is because the actual fine he puts on your car is NOT enforced by the Fines Enforcement Registry. It's a private fine, let's just say. Any case of non-payment WILL NOT be pursued by the Fines Enforcement Registry, which means non-payment WILL NOT cause a driver's license suspension. Any case of non-payment (not that this happens, since gullible people like me pay up there and then coz they are not aware of this) is a private legal matter.
Assume he would just give a fine to people. It's not enforced by the govt, he doesn't have that luxury. He would have to take you to court over a $150 fine, mate, it ain't worth it for him. He knows that, that's why he relies on people not knowing their rights and the laws there and then, and clamps them to make them pay on the spot so he doesn't have to worry about recovering that money later. The local council by-laws (I have checked this by the way) which state that there are fines in certain private carparks (they're usually quoted on the 'no unauthorised parking' signs), if you actually read it, they merely state that the private parking owner has the right to fine offenders. However that is as far as the by-laws go, there's no responsibility on behalf of any govt body to enforce it, it's the private operator that worries about this stuff.
How much does a wheel clamp cost? Dunno, but let's just say 100 bux (some1 correct me if I'm wrong). Plus $150 unpaid fine. That's $250 he can sue you for. Firstly he'll be waiting a while for a court date. Secondly, it won't be worth it for him to waste his time in court if he can clamp three or four people in the meantime. More and more of an argument to cut the fu(kin thing off and drive away. Scitech for example doesn't get any proceeds from the fine, only Duane does. Ask yourself, if you clamp something like 20 cars per day @ $150 each, are you going to waste your time and lose a guaranteed another 500 bux over an unpaid $150 fine. I wouldn't...
