Well, I was booked again tonight for speeding, which will put me back to 2 points left again for another 9 months. If your wondering, I was busted doing 74 in a 50 zone in my Mrs Hyundai Accent. Now I wasn't paying attention to my speed, and I take responsibility for that, but the thing that 5hits me the most is how I got done. Going down a hill (decent would be approx 30 degree slant) which really ticks me off.
Now my enquiry is can you be fined for speeding on a decent?? I wouldn't mind arguing this, I guess coppers would not be there if they were not allowed, but I have to ask the question anyway. If I have to take it on the chin and move on, I will, but would like some advice on this. Will most likely be calling a lawyer that deals with traffic infringements for some advice, if they can do anything it would be nice, but on the same note, I couldn't be bother spending loads of money for save myself 3 points and $238.

I've always wondered about representing yourself? I think the worst that can happen is you have to pay about $50 extra court costs. You might even luck out and get the police to drop it to 15 or 20 beforehand if they think you have a case?

Maybe if it was closer to 50 you'd have a chance of getting a judge on your side, but at 24KM/h over the limit, you must have known you were way, way over, and the judge would know that too.
I'd say just pay the fine and lay low for 9 months.

On the same note Dave, I represented myself when i went to fight a Lisence Suspension. Just so long as you provide a Good Affit-Davit, a letter from your employer/s dress nice, be polite, and show that you knew you were being stupid, and sincerely sorry, then you stand a pretty good chance.
It also helps if you have a relatively clean record.

As for the question about "can you be fined for speeding on a descent", yes, of course you can. Why do you think you have brakes? Do you also imagine you should drive through a red traffic light because the car does not stop by itself when you take your foot off the throttle?
You could go to court but I would not be surprised if the magistrate listened to your argument ("I wasn't paying attention to my speed") and invited the police to add dangerous or negligent driving to the charge sheet. He would be right, too.
Take your own advice Steven: take responsibility and move along. Also, next time pay attention please; I might be on the same piece of road as you.

good idea steven as my bros girl friend tried to take it further and she was on a 45degree decent and about that much over she got a no deal from her lawyer she had to cop it on the chin and suffer for 6mths no license.

By the way people, the word is "descent", not "decent". The latter is the antonym of "indecent" which might be regarded as a form of descent but perhaps not the one you first had in mind

if youre in vic, dont bother trying this.
last time i was in court i was watching the amount of people trying to get out of a suspension and the judge said to all of them, "the rules have changed and you cant avoid your suspension, youre wasting your time"
i really wouldnt bother taking it to court, i doubt you will see a positive result and will end up having to fork out more $$$ in the end
but its your choice

In NSW even if you succeed at having your fine overturned, they still take the points off your license...what is the point of fighting it in court then!

as far as i see it , if you speed in a 50-60 zone your a tool!! kids walk our streets!! i have hoons doing 100+ PAST MY HOUSE IN A 50KM ZONE!! tools tools tools. thay deserve to have the licence taken!

Ok you can settle down now, easy tiger, if your that concerned about people doing 100 clicks down your street, do something about it. We had the samething on my street a couple of years back, we got together in our street and had a discussion. Final vote everyone was pi55ed off about it, so we knew who they were, each time we heard someone speed down our street we kept a eye out (because you could hear them in the adjacent street coming back around and every single person on the street rang the cops. They were down in 5 minutes with 2 patrol cars. This happened for a period for 2/3 months, eventually the people got the picture, hasn't happened since. Bottom line is less talk more action, don't whinge about it act on it. Just hope you have friendly neighbours like I do anyway.
As for my license, I haven't lost it RTA update their database every quarter online, so I'm sweet for now touch wood.
