Hi guys
I have a serious problem. I live in a townhouse and the neighbour constantly parks across my driveway obstructing me from entering or leaving my garage. I have notified body corporate 2 weeks ago about this matter. And the neighbour does not seem to care. I have notified police and brisbane council; both parties ensure me that they cant do anything as it is on private property and I need to consult body corporate. How can I notify body corporate if they dont operate on the weekends?
I have approached the neighbour and they move their car but they continue to park across my driveway. I would like to know my options? Can I call a tow truck to tow away their vehicle at their expense?
My temporary solution is to constantly beep and hold down the horn. Surely, I have some rights?

Start taking photos and logging events in a diary. Get a cheap solicitor and commence proceeding to recover costs (loss of wages etc) from them. The first letter should be enough and probably only cost you $100.

Some people are just so inconsiderate it is hard to understand. Part of me wants to suggest that you start parking across their driveway, but that is unlikely to be productive, though it may get the message across and make them realise how annoying it is. Maybe put something in your driveway for a few days to prevent them parking - eg. your garbage bins, they might get the message. Alternatively you might park them in so they can't get out. Then they have to come and ask you to move your car.

inform your body corporate that if it continues you will be calling a tow truck on thier behalf. by not sorting out the rental issue they are breaching the terms of your lease by not inforcing the body corporate rules on other tenants.

David, having lived in a body corp situation and having been in the committee, I strongly suggest you lean on them with a letter of your complaint. Make sure you date it and keep a copy for yourself. Don't post it, but hand it to the secretary and suggest an answer would be appropriate within the next few days. It is their job to sort things like this and this is part of what your rent money is for. (not that the committee get paid). Even a friendly note under the windscreen wiper might also help, but enflaming the situation might just lead to more angst.

I used to have a idiot block my driveway at my house (not a rental) daily. Tried council, letters of demand police etc and got no where. The only thing that worked in the end was to buy a $500 puss box and gave him a nudge out the way a few times. After a lot of ranting and screaming he never blocked the drive way again.

There are some great responses to this matter. Thank you very much. The neighbour has stopped parking across my drive way but their friend's car is in their place. This is an extremely frustrating experience for me. I am trying my best not to aggressively abuse the other party.
Strata management/Bc has not been on the premises this week and are not replying to my voice messages or emails. I hope to see them tomorrow or I will be phoning them to arrange a meeting from then, I will show them a photo of the culprits as proof.
To be totally honest with you guys, I want a total ban of cars within the complex unless parked in a garage or visitors bay. To build some context, our street is narrow and it sucks when people decide to park on both side of the road. Is that to much to ask for?

Hey dave, I'd suggest leaving them a letter directly,
"Dear Sir
It has been unfortunate for me over the last few weeks that you have obstructed my driveway. This has caused me significant trouble and time. I cannot allow any more flexibility and if this matter happens again I'll be forced to take legal proceedings.
Please feel free to read up on legislation as I already have, and decide for your own economic path whether it is beneficial to you to continue obstructing my driveway.
Should this happen longer, I'll see you in court.
Sincerely,
David Tra"
Even as just a bluff, it's usually enough. Otherwise during the night I'd suggest start making it economically disadvantageous for them. You can get from ebay or from supercheap auto, it's called a tyre valve puller or similar, and literally it'll pull out their tyre valve. Just every evening when they're across the driveway, just pull a few valves. Two. So they can't move the car to the shop, but if they took the tyres specifically it'd only cost them about 15 dollars to get new valves.
If they took you to court over that it'd be a sh♥tfight but if you could say in court: 1) I tried bodycorp 2) I tried police 3) I tried to send them a letter of demand 4) I then took action which would inconvenience them, not financially, but time. Much like I had done to me, to persuade them that it would not be in their interest to park in my driveway.
If they fined you the cost of tyre repairs it'd only be a matter of 30 dollars then.
Do you own your property? In many cases trying to get strata to do anything out of their way is useless. Do you have beef with this particular neighbour, and are they owner occupiers or tenants? If tenants get into contact with their landlord.
Leave a note on their car asking for them not to park in your driveway. Probably won't work for in this instance, but to piss someone off my old work property (car parked overnight) we wrote on the windscreen with a white out pen blocking the driver's view that they had parked on private property and not to do it again.
If all else fails take their numberplates off and do petrol runs?

Yes. I own the property. The neighbours have stopped parking across my driveway. They are on their final warning by strata. But Ill pop their tyres if they do it again. Thanks Aidan haha
