Below are text messages, emails and the dates communication took place, presenting my case in a reasonable manner and sticking to the facts.

November 3rd, 2011 Text to Joshua Baldwin
Hi Joshua.
I have had some issues with the air con compressor I bought from you recently.
I went to have it fitted and have been told that the bearings are noisy and have been recommended not to waste more money in fitting it.
I bought it from you only because you said it was perfect.
What now?

Sorry for late reply I am currently on holidays.
The compressor you have was removed from a absolute mint condition soarer,
inside through to outside was unmolested and stock the only thing done was a full emv mod which is around a grand.
Now back on topic with the engine.
It had a full logbook service constantly serviced and maintained if something needed doing it got done.
Air con system worked perfectly without error,
no noisy bearing sounds were to be heard just before I bought the car a full service was done aswell for a relatively high km 1uz it was by far best I have sold the water pipes on the engine even still looked brand new with no corrosion.

A brand new compressor can be anywhere around the grand mark.
Which is why everyone sources second hand ones.
So if for instance the bearings had gone why would that make it a throw away its just bearings and a pretty sh*t excuse.
So its word against word.

You advertised it as perfect condition, it isn’t.
I bought it believing it is in perfect condition, and its not.
So it isn’t a sh*t excuse.
I’ll send it back and I want a refund please, you can sell it again to someone else, since you are the trader selling perfect parts.

Mate I know your deal.
You thought you needed an air con compressor to fix your system.
Your parcel didn’t come in time of your booking and they fixed it without needing another compressor.
You are just trying to get your money back because you don’t need it anymore.
Well I’m not a f*cking loan service so you bought it and you do what you want with it now and stop hassling me.

Stop being a child. My system is not fixed.
I had to get another unit ordered, my mechanic has given me a letter to say the unit I got from you is no good and has noisy bearings and if fitted will not warrant the fitment.
So as we text little boy, my car is still waiting for a compressor to be fitted.
You said you were an internet trader.
What’s your policy of returned goods which are faulty?

So what has happened to date. Nothing really.
I haven’t heard from Joshua since, I have emailed him on several occasions, and also texted,
attaching a scanned copy of the letter which I requested from my repairer, see attachment below,
to show him I was not making it up, and again no reply.
I paid $300 posted ($281.45 for compressor + $18.55 post) for this second hand, "perfect" condition aircon compressor.
I found on ebay a re-built unit from the U.S and I paid US$273.15 posted ($210 for compressor and $63.15 post) and once it was paid, it was at my door in less than 2 weeks!!!!

Payment was made by internet banking to Joshua Baldwin’s account on September 29th, 2011.
I emailed asking how far away was compressor on October 7th, 2011.
Received email from Joshua on October 9th , 2011 but no answer about compressor.
I emailed again asking how far was compressor on October 11th, 2011.
After receiving no replies I again emailed Joshua on October 13th, 2001, this time I was requesting a refund on the purchase of the compressor as I had not yet received it.
Same day I received an email apologising for the delay, this is the content of that email
“hey buddy sorry have replied a couple of times in regards to see if i have the other parts.
been very busy with work haven't been able to make it to the post office sadly and your not the only one but there been patient to. its been made pretty clear im a decent seller though due to work commitments postage can vary so again im sorry.

your item is getting posted off tomorrow as im going to start work a couple hours earlier in the morning so i can finish earlier to post of my customers parts.

sorry for the inconvenience and delay and hopefully it dosen't ruin future business.”

I again emailed for a refund on October 13th, 2011.
And again on October 14th, 2011 with this email
“Hi Joshua,
To be fair, you said other people are being patient, that's ok, it seems they have to, they aren't given another choice,
but are you communicating with them that they are going to have to wait.
Please don't spiral out of control in the belief that I think you are a bad seller, I'm not heading in that direction,
and I feel that this will not affect future transactions with you, unless you let it, but you do frequent the internet very regurlarly
and thus communicating with your customers when your are online where their stuff is would be a positive for you when Life gets in the way.
And then you won't get people like me, hassling you, that expect their item delivered before 2 weeks is up, because that is what I expect from a seller,
unless otherwise communicated, as this is what I try to achieve when people purchase goods from me, and I'm not trying to be in anyway an Online Trader like you.
Stuff I have purchased from the US, and Germany is normally quicker to arrive than that.
So I ask again, is it possible to get a refund please?”


After October 14th, 2011, Joshua and I spoke on the phone, and I was reasonable to his excuses and awaited my aircon compressor.
It finally arrived, a week later!
Joshua promised to post it on the 14th of October, the postage payment details say that it was posted the 18th of October.

Another bullsh*t lie.

This post is only to highlight the lack of professionalism he reckons he has with his customers, and to warn those who may have dealings with Joshua.
Its great that he is out there making a quid, and probably working hard on it to make it work for him, but my issues are that he took 3 weeks to post my item, no communication as to where he was up to with sending item, telling me he will post it one day and doing it 4 days later after I requested a refund, and the worse part is that it was supposed to be PERFECT and has been deemed faulty by a professional aircon installer, and now he wont give me a refund, or return my emails.

As a consumer and as a customer of yours, I wanted to know what is your refund policy, as a forum and internet trader, when the item you have sold is found to be faulty,
or not as described?
Is it your policy to tell them to f*ck off, and leave you alone, like you have me,
or do you look into the problem, because the issue could be legitimate, and there is a problem with the goods you have provided.
Also what is your policy when you have misinformed potential buyers?
Why didn't you state that the compressor came out of a "perfect" car, instead of being deceiving,
withholding that information and stating that the compressor was "perfect"?

I believe that an internet trader needs to be fair and see past the individuals that are trying to wrought him,
as I believe that I am not trying to do that.
I also believe the reason that a consumer may be complaining IS because there is a real issue?
Now I'm not asking for a refund from you because I changed my mind and don't want the item,
I'm asking for a refund because the item you have sold me IS NOT as described,
it is not "perfect" as you have posted on Soarer Central, or on Aus VIP,
I want a refund because I have been adviced by the repairer that was going to install this unit that the item in question is not in good working order and recommend that it not be fitted,
I want a refund because I bought this item in good faith that it was in perfect condition,
not from a perfect condition car, as you have texted me and adviced as of late.
There was nothing in the posts you made on SC or AUSVIP to say that this compressor came from a perfect car,
all that was advertised was that it was in perfect condition.

I think that you should, in good faith, honour your good trader status, and refund this item.
I have attached the document from my repairer stating that the compressor is not in a condition to be fitted.
There is contact numbers, a business address, aswell as an email address that you can contact, to verify that I'm not trying to scam you.

Hmmm interesting. I bought a second-hand coil lead from Josh Baldwin a while ago and it was OK, apart from a broken clip which I didn't know about until I received it. I paid $10 or something for it so I didn't really care - the lead was shorting against the block and any working lead suited me fine.

Sounds like you got fooked Fran... sucks to hear it mate.

Hey if his profile is right, and his DOB is 12/1992, what the hell is the poohead doing with three V8s in Victoria? If that's the case, he could have only held his Ps for less than 11 months, and I'm pretty sure you can't have a V8 until you're fully licensed these days...

Something doesn't stack up. By the way, there's a J Baldwin on a fairly well-known street in Golden Square, a suburb of Bendigo. Wonder if that's our guy?

I've bought heaps of stuff from Joshua Baldwin, a PERFECT CONDITION fuel tank, I mean absolutely MINT, as described. Interior parts, engine parts, trims, ALL have suited my application.

He even went to the trouble of arranging for a courier to pick up from his work place to accommodate a cheaper form of transport to get it to me in Northern Territory on multiple occasions.

I couldn't be happier.

When you buy second hand, you pay less for a reason: There is risk involved, it may not work for long, it may not work as is intended. If all secondhand stuff was absolutely perfect, it would be the same as retail new price wouldn't it?

BTW, most auto elecs wont fit a used or customer supplied unit. My auto leccy wouldnt even fit a Reco'd unit that was new from Rob Hayden, complete in the rebuilders box with fitting instructions.

most mechanics are just asking for trouble when they do. The customer thinks they've got something awesome at an awesome price, later on it packs it in, customer turns around and blames mechanic....etc....etc.....


No one wins. Customer unhappy, out of pocket. Mechanic bad mouthed, wondering why he bothers trying to help.

I bought a EMV and airbox off Josh , i will admit that they took a long time to come , although he did apologise , both arrived in good condition and the Emv was in great condition , no dead pixels etc as described

I don't think the issue is so much about the parts not being as described (although that is an issue in its self) but rather his attitude to customers when a problem arises and his attack on them really surprises me.

I know there are two sides to the story but you don't treat potential clients like that.

there was a listing of soarer front bumper indicators and 91 bumper turning lights for sale i won the auction and just said. look mate chuck the bottom lights out for me as i already have 2 sets and dont wanna waste your time with posting them il still give you the money the whole lot was won for and problem solved all i need is the bumper lights.

No, we haven't had bad dealings, however you could have told me the clip on the coil lead was busted. Big whoop, like I said, it's only temporary while my Soarer is parked up til I graduate from Uni. I'll get all new stuff when the time comes.

I'm sorry if you feel this way, but I think you've brought all of this upon yourself. You can get as defensive as you like but at this stage I don't think anyone is listening. I didn't post your address, your phone number, your sexual orientation or preference for Nando's basting, so really you've got sweet fook all to complain about. I also think all the attention is on you in this particular thread, so it's pretty pointless trying to redirect it to me. Besides, if I really wanted to attract attention, I'd be correcting your spelling and grammar...

I haven't cut Joshua's access in order to allow him to respond to the original post.

It seems the issues raised have been neither denied or addressed however.

I have had to ask Joshua twice previously to address the concerns of people he was dealing with.

As more people have come out with problems dealing with Joshua - and not just from Soarer Central - and he posted yesterday that he was leaving the forum, I feel I have no choice but to enforce that with a ban.

I wasn't aware of that. It might be different here in NSW because he was happy to do it as he knows the cost from Lexus for a new one.
Its not the first second hand compressor he has fitted to my cars.
As long as its in good condition, 3 of them and never have had an issue since.

I agree Aaron, but when it states in the ad that it is in perfect condition, you don't expect it to have bad bearings in it.
But if you do a search on Ebay now, you will see that a rebuilt unit from the US is actually less than the "cheaper" second hand unit.
I just wish I had stumbled on the Ebay post first!

I would agree with you, as the other bits I've bought off him were good.
$300 is a lot of cash to mislead someone with a description of "perfect".

Hey Josh, I don't feel you should be banned, (however it seems that from everyones reactions it was just a matter of time) because you are like the rest of us, a car enthusiast, and these type of forums need enthusiast to keep from folding, but I think you don't really understand that if you honour your position as an Internet Trader, with rules and policies, you will have a prosperous future selling these sort of second hand parts because there is a market for this type of thing, but you need to have some kind of self respect that when there is a fault, that it needs to be fixed, its really not that hard.....or is it??

It's a shame it has come to this.
I haven't had any bad dealings with Josh.
Came across him this year and found it handy that someone fairly local is wrecking soarers.

He always went out of his way to deliver things I bought to my house (half hour trip). A number of times he even picked up stuff from Melbourne for me when he was going down to drop parts off for other people. One of the nicest guys I've come across.

Unfortunately not everyone has had this experience and I can understand people's frustration when parts they ordered don't get delivered.

Hi Ross, I probably would agree with you here, because in my past dealings with him, he has been good.
However after I requested my money back because of the huge time lapse between payment and delivery, thats when it kind of went sour for me personally.
When I requested a refund he had still not posted it. Why not just give me my money back? He said others had shown interest. It would have been sold anyway. I feel if the shoe was on the other foot, I would have refunded him. Especially when it took another 4 days after I spoke to him about the refund to post the compressor to me.

Mate - it's always a gamble buying online, especially sight-unseen from an unknown entity such as a seller without a reputation on a forum.

The delay is inexcusable, I would never do that to a buyer especially for an item worth a few hundred dollars.

The compressor very well may have been 'perfect' when he pulled it off the car. Give him the benefit of the doubt for a moment and put yourself in his shoes. You pull a part in good working order from a car and post it out. The buyer then bombards you with complaints and demands a refund. You have no idea what happened after you packed it and sent it, but you know it was working before you did. What are you going to do? You could be nice and offer a partial refund, but you are not obligated to. Sadly some people have no integrity and won't offer to compensate or negotiate. Legally they don't have to - he's not a business trader? I'm guessing you didn't get an invoice and he didn't charge you GST? Because of this you're not protected by buyer protection laws in the usual sense.

In this case the online-buying gamble didn't pay off for you. If I were in your position I'd take the $300 hit and move on unfortunately... It's an expensive lesson, but what can you really do?

To protect yourself in the future always pay with paypal. This way you can get your money back with less hassle should you not receive the item within a reasonable time-frame. The buyer is also then obligated to negotiate if the product is faulty or not as described. I've had to do this a few times, and the outcome has always been successful.

Don't let one bad experience put you off though, there are a lot of good 'kids' out here too. :-)

That's my 10 cents anyway...

To be fair, he is just a teenager - most kids I know that age are pretty lazy and would find it hard to get to the post office - especially once they already have the money - likewise even the car enthusiast teens I know wouldn't know how to tell a good bearing from a bad one by listening to it - they are still learning - and most of them are also hotheaded and refuse to admit when they are wrong - hell, I was like that! But you learn as you age. Doesn't excuse, but does explain.

I'm pretty sure Josh is only 19, it's unfortunate that it had to come to this because from my dealings with Josh, he's not only helped me out but also my housemate. I guess you should always treat people how you find them, buying things online is always a gamble but in saying that, I've brought from Josh with confidence before and I would do it again. Each to their own.
