HEllO, i just wanted to have a BIATCH about the cops in this place!
on saturday night after working in sydney doing a promotion until 11:30pm. I was driving home to newcastle (2hrs +) and 5 minutes from home, 1:10am i get pulled over by the cops for turning left not from the left lane (see diagram... i'm the red arrow!) Right... so this is my first ever infringement first time even breath tested. and i get whacked with a $180 dollar fine and 2 demerit points! I'm a P Plater so thats half my licence GONE!!! so what do you guys think i should do? appeal? pay up? go to court? its just so frustrating, it was not dangerous there were only 2 cars on the road, me and the cops grrrr.

P.S for anyone who knows newcastle it was coming from sydney at the intersection of the pacific highway and the esplanade (turning onto the road that goes past 16 fts)

I gotta say you were in the wrong mate. Turning lanes aren't meant to be crossed when turning. You could take the case to court and argue it til the cops give up, but that's your choice. Might be a bit hard to win though.

I do think the police could've let you off since you didn't pose any immediate threat to any innocent bystanders, but then again they were out in force this weekend for a reason.

Police are out in force this weekend in the lead up to the Christmas party season targeting drink drivers, speeding motorists and warn anyone caught will be dealt with the full extent of the law.

Operation Drink Drive 2 commenced at 00.01 on Thursday (9 December) with police breath testing over 34,300 drivers across the state on the first day of operations.

Forty-six people have been charged with PCA since the operation commenced while an alarming 1284 people have been detected speeding, compared to a total of 760 for the operation last year.

“This is absolutely shocking. Drivers need to slow down and obey the posted speed limits not only over the operation, but whenever they are out on the road.” Traffic Services Commander Chief Superintendent John Hartley said.

“There’s nothing more heart-breaking for officers to let the family of a loved one know they’ve been killed, especially when it is preventable.

“If you get behind the wheel drunk or speed, you’re endangering your life and that of other road users – it’s that simple,” he said.

Some examples of irresponsible behaviour by motorists include:

* A 19-year-old p2 provisional driver was detected travelling along the F6 at Unanderra at 138km/h in a 100km/h zone. She was issued with an infringement and her licence was suspended on the spot.

* A 57-year-old from Oak Flats conducted a u-turn to avoid being breath tested, but was tested a short distance away and returned a reading of 0.160. Her vehicle was also unregistered and uninsured.

* About 12.40am today, a Toyota Celica was stopped on the Pacific Highway at Wyoming. The 36-year-old driver was charged with high range PCA after returning a breath analysis of 0.195. She is due to face Gosford Local Court later this month and her licence has also been suspended.

* A 19-year-old Canadian female was driving along Tennyson Street at Byron Bay when she seen to almost hit with a parked car. She was stopped and breath tested by police returning a blood alcohol reading of 0.180.

Police have also booked 1626 motorists for other offences – up 624 on the same period last year. 81 motorists have also been issued infringement notices for seatbelt offences.

RBT units remain out in force state wide. Operation ‘Drink Drive 2’ ends at 2359hrs on Saturday 11 November 2006.

Out of principle you should take it to court and fight it.

In reality, you'll lose and have to pay court costs on top of the fine.

You coc*ed up, take it like a man and be more careful in the future.

Be thankful you didn't get your car confiscated under the 'hoon laws'.

Is it curious that all the examples given were female drivers? Does the author have a problem or do the police?

If the scale in your diagram is accurate (reasonably) then they were assholes. Providing Im looking at it correctly that is a parking lane on the extreme left of image. Your not meant to drive along a parking lane; so you shouldn't have been in that lane to turn until it ended. Which is pretty much how your red arrow indicates.

If however you had access to the slip lane earlier than is indicated and you just stayed to the right to 'straighten' the corner - your screwed.

When I was on my P's I went past some cops, they didn't signal me at all, so I drove on past. They chased me, pulled me over, gave me 1 ticket for 72 in a 60 1 point(the cop didn't even have the radar on him) and 1 ticket for disobeying police directions 3 points. P's gone in one hit.

It sounds like you're all pretty much used to dealing with cops but anyway, about a year ago, I was driving down a busy-ish road when I noticed a few hundred metres behind me a cop car approaching quickly. I took a quick check of my speedo and OMG I'm doing 75 in a 60 zone.)(Not on purpose). So I gently slow but plod pulls me over anyway. He was pretty aggresive and kept asking 'what speed were you doing?'

I realised that he'd not had his radar (or whatever it is they use) on me so kept telling him "I don't know, probably about 58 k's"

He shook his head and repeated his question several times, trying to bully me into admitting I was speeding but I'm not one to be bullied so I just repeated my answer. They gave my Soarer the once over, checked the complience etc, then buggered off.

I've scince discovered (from an ex- cop friend)that cops often have a tiny microphone attached to their wrists, which, as they lean into your car, they can record whatever you admit to! Never admit to anything. Never!!!!

From my understanding, if a cop pulls you over for speeding without a radar gun or such, ie. they were following behind you or something, they require two cops in the car to verify your speeding. Which is why when one pulls you over, they try rather hard to get you to admit to speeding. Its a very harsh tactic, I've had a cop try it on me once, but I just kept telling him I was doing the speed limit (which I more or less was anyway) and he couldn't do anything about it (which in his book apparently meant he should try to find something else I've done wrong).

The funny thing is that while I used to get pulled over all the time in my old car (old Corolla Seca), I've never been pulled over randomly by cops in my Soarer.

Doing 75 in a 60 zone might be fine in some places. Not knowing you are doing it is negligent.

Definite fine in NSW. 15KM/h over the speed limit = 3 demerit points. I'm surprised he let you off.. But I guess that shows that not all policemen are out to get you.

hmm here is a question relating to the law around my original infringment... if the left hand turn lane doesn't have left hand turn arrows, and the other lanes don't have any arrows (so no arrows at all) can't you just argue that the extra lane is there to stop people parking close to the corner... what is the law in regards to this?

Relating to other stuff as above, i think it hugely depends on luck, ie what cop you get

Followed by "can you show me please?" - in NZ they don't HAVE to show you the reading by law, but usually if they won't its a sign they are bullshitting you and it might be worth taking it further.

Ryan, at the end of the day, its only $180, its only 2 points, its just unlucky you only have 4 points to play with, but such is life.
Just be lucky he decided not to give you a harsher penalty, which may have been 4 points, which would have resulted in loss of license.
