I was speeding. Got done on an apparently bad stretch of road near gympie. I thought it was just the usual roadworks with no-one working on the weekend syndrome and when I passed all the new bitumen I took off again. It turns out the road has just been modified and the speed reduced. I thought I was in a 100 zone but was still in the 80. I got done a fair bit over but he was nice enough to drop it a few kay's and do me for the lower limit which was good of him. All I can say is thank christ he did not ping me 30 seconds earlier when I was hammering past a tractor at the tail end of an overtaking lane.

But surely if you are doing a speed then that is the speed that you should recieve the ticket at.

Hey don't get me wrong I don't wish any extra badness to you but in those circumstances you are not being charged with the correct offence perhaps it should not stand up in court.

This whole idea of reducing the infringment borders a little on keeping you on the road so they can get some more cash off you another day.

When they write the speed on the ticket they are making a statement that this was the speed that you were going. You can't just go making false statements and expecting money to be paid.

But I say that with tounge in cheak.
It is nice to keep your licence if you get into that situation.

However, All this flexing or altering of the laws should be stopped and if it is practice to bend the law then it must be in need of review.

My friend recently lost his licence similar circumstances to Perry.the difference to him keeping his licence and his job was 4kmh.he pleaded this with the cop but cop issued it like that anyway.cops have the power of discretion wether theye use it is up to them.

he was in the wrong for speeding in the end.

Yup, I woulda worn it had he done that. You are exactly right Muz. The signs were there and I did not pay enough attention so he had every right to do me for the bigger fine. I think my previous clean record may have swayed him a bit too. Either way, I am very grateful and thanked him for doing that as he was not obliged to do so.

its also easy to lapse into a state of mind were you do lose that concentration for a fraction of time and speed for a couple of hundred meters then realise and slow down.i think there is a difference compared to someone blatantly speeding and dogding in and out of traffic.

on average thanks to my employment i drive 60-70000 kms per year..and i know from experience this can happen.99% of the time im well within speed limits the occasional times i do speed not by much but quickly adjust my speed.its a minefiled these days with speed zones constantly changing even on the same stretch of road.

driving requires more concentration than what was needed years ago due to the ever changing speed zones and extra traffic on the road..

oh and i hope you are taking a lawyer with you ..if not i would ask for the hearing to be heard on another date.dont make the mistake that you can defend yourself.
if you do lose the court battle lodge an appeal strait away that way as far as nsw goes you keep your licence and a district court may have sympathy more than a localcourt.

there is a by law called section 10 in nsw were the charge is proven but dismissed.you are put on a bond type situation so you can still keep the licence etc.im no lawyer so ask them about these points.

I noticed the cop do a u turn across double white lines and then do about 20 more than me to catch me who was doing 20 over also. Hmmmm. But happens.

That's crap - anyone should be happier that they don't get more points / loss of demerit points from the cops - everyone seems to whinge about them and when they do something that they DONT HAVE TO DO and is a NICE THING TO DO, they still cop it, wtf??

The cop isnt going ohh yeah we'll just give him a little fine and take some money off him so I can do this with it and then get him again - that cop wont see any of the money and he doesnt know how many demerits you have left unless he radio's through to ask so I just wanted everyone to be made aware, I think that with the quality of your information Steve pulling over cops isnt a practice I would suggest you keep on with.

I agree Steven (Hille). It's like a judge. He CAN do you for 20 years for a crime but he takes other factors into account and may only give you 5 or whatever. I shoulda blamed it on the 90kmph tailwinds we had up here on the weekend lol.

I hear the weather hasn't been so flash in Perth either but im up in Karratha at the moment with blue skys and mid 20's (and unfortunately im not talking about women). Coming into cyclone season soon though could make life interesting

I agree with what you said in your previous post Stephen. I think that if you begin stopping traffic police they will eventually get sick of it and keep an eye on you more, so that on that one day when you accidentally go 3 km/hr over the speed limit down hill on cruise you will get booked.

I got stopped once for taking off from the lights a bit quick and getting a bit above the limit before backing off to where the limit is.

He was very nice about it and just told me to take it easy since there were much police out that night (yes, he said that). He then checked my driving record and let me go. I was not going to argue.

My thoughts on Police writing up the tickets for a lesser speed than you got caught for is that the person receiving the ticket will think they have already been let off lightly and be less likely to take the matter to court as they dont feel as hard done by. If the matter still goes to court the the police will argue that they have already given a degree of leniancy and that the penalty should be increased rather than further reduced.

Just my thoughts. I have had the police write me up for a lesser speed than what they actually caught me on radar and camera doing, so i cant complain, it meant i "saved" aprox $1000, 2 demerit points and i only had my licence suspended for 3 months instead of 6.

Yep, I have seen it happen plenty of times to me, my brother and my friends. Doing say 125 in a 110 zone and the cop drops the speed to 120 so that it is a lesser fine and less points. It's all about the attitude, of the cop and from yourself. If you know you are in the wrong, there is no use bunging on a bad attitude, it's your fault, and you knew it ha ha (I am not having a go at anyone here btw! :-) )

I would find this highly unlikely As Stephen Hille said, the cops don't see the money. Wheather they get $10 off you or $110 off you means nothing to them. They are just trying to be nice, probably because they know that a lot of people have a problem with police. Remember, not every cop is out to get you, only a very select few on power trips, but this has been discussed to death in the other thread. I do have to say though, that after speaking about it with Stephen Hille on that thread, I am coming around to his thinking. I still don't like the cops that are on a power trip, but he has made me remember that I have had a lot of cool cops, and I forgot about them because there was nothing special to remember. You tend to only remember the ones that give you a hard time, and I haven't really had too many of them.

There are some laws that I don't agree with, but I can see why they are there, and I can see that they are hard to enforce unless generalisations are made, so in the end, I suppose I am glad that they are there, even though it makes life hard for me to modify my car the way I want to, at least it could help save someones life in the case of "Chopped" springs rather than lowered springs etc. causing bad handling rather than improving it.
